Immediate notification process

Hosts must notify P6 Projects immediately where a staff member is injured, suffers illness or is involved in (or been witness to) a dangerous or notifiable incident.

P6 Projects employees, including apprentices must immediately notify P6 Projects they are injured, suffers illness or is involved in (or been witness to) a dangerous or notifiable incident.

Duty to preserve incident sites

The person with management or control of a workplace at which a notifiable incident has occurred must ensure so far as is reasonably practicable, that the site where the incident occurred is not disturbed until an inspector arrives at the site or any earlier time that an inspector directs.

  1. A site includes any plant, substance, structure or thing associated with the notifiable incident.

  2. Preserving and incident site does not prevent any action:

  • to assist an injured person

  • to remove a deceased person

  • that is associated with a police investigation

  • for which a SafeWork SA inspector, or the regulator has given permission.

  • that is essential to make the site safe or to minimise the risk of a further notifiable incident

    Duty to notify of incidents

P6 Projects must ensure that the WHS regulator (SafeWork SA) is notified immediately after becoming aware that a notifiable incident arising out of the conduct of the business or undertaking has occurred.

  1. The notice must be given by the fastest possible means.

  2. The notice must be given by telephone; or in writing by electronic means.

P6 Projects are responsible to immediately report notifiable workplace incidents to the applicable Regulator/s.  For particular incidents, e.g. electric shocks, more than one regulator must be notified.

The Regulators

There are three Regulatory bodies within the South Australian state jurisdiction that the P6 Projects may be required to provide workplace incident notification to.  Notification to any of the Regulators is determined by the type of incident.

SafeWork SA

Reporting 

It is a legal obligation of the CACL to notify SafeWork SA of any work-related injury that requires treatment as an inpatient in a hospital immediately after the injury (disregarding any time taken for emergency treatment or to get the person to hospital).

This legal obligation does not lie with the hospital. In accordance with section 38 of the Work Health and Safety Act 2012 (SA) as a PCBU, P6 Projects must notify SafeWork SA of fatalities, serious injuries and illnesses, and dangerous incidents that arise out of the conduct of the business or undertaking, as soon as you become aware of the incident

Incident Events

All incidents involving electricity must be reported to the Office of the Technical Regulator by the electrical worker, or by the person with management control of P6 Projects premises where the incident occurs. 

Reporting

The timelines for reporting electrical accidents depend on the severity of injuries sustained in the incident.

  • Death must be reported immediately via telephone 8226 5500.

  • Any accident where a person requires medical assistance must be reported within one working day. 

  • All other accidents involving electricity must be reported to the Office of the Technical Regulator within 10 working days of the day of the accident.

  1. Notification 

  1. Reporting electric shocks and incidents.  All incidents involving electricity must be reported to the Office of the Technical Regulator by the electrical worker or the occupier of the premises where the incident occurs. If the accident occurred in a workplace you must also report the incident to SafeWork SA.

Environment Protection Act (EPA)

Pollution (incident) events

Pollution events may cause, or have the potential to cause, environmental harm in the form of environmental nuisance such as noise (civil construction), odour and/or visual impacts.

Reporting 

In accordance with Section 83 of the EPA Act, in the event of an incident that has caused or threatened material or serious environmental harm a licensee must, as soon as reasonably practicable after becoming aware of the harm or threatened harm and in any event within 24 hours, notify the EPA of the incident. 

If you are unsure whether an accident is actually a 'pollution incident', it is still best to contact the EPA, and they will assist you. Any person (including licensee) who is responsible for a pollution incident is required by law to notify the EPA as soon as possible.

Notification 

The initial phone notification must include the following details:

  • location of the incident

  • time and date of the incident

  • nature of the incident

  • name of the licensee

  • name and telephone number of an appropriate contact person.

An officer of the EPA will return your call to gather further information and where necessary, arrange attendance at the incident. Following the initial notification, the EPA may also require a written report detailing:

  • the circumstances leading to the incident

  • actions undertaken to remedy the situation in the short term

  • longer term actions that will be taken to prevent a recurrence of the incident.

When requested, this report should be submitted to the EPA within five working days of the incident occurring using the general fax number: (08) 8124 4674. Reports should be made to the attention of the Manager, Emergency Response Team.

Records Management

P6 Projects must keep a record of each notifiable incident for at least 5 years from the day that notice of the incident is given to the regulator. Records of notifiable incidents shall be recorded and maintained on P6 Projects technology platforms.

Responsibilities

The Director is the officer responsible for ensuring that P6 Projects meets all legislative obligations in respect this policy and ensuring employees are adequately trained to perform their work safely. 

Managers are responsible for ensuring that the principles of this policy are adhered to in all activities within the day-to-day operation of their service.
